Updated and effective July 21, 2023: Arizona House Bill 2197 Title 14, Chapter 25 with regards to the execution of Electronic Wills and Codicils using Remote Online Notarization (RON). Updated were clarifications of the requirements for a Qualified Custodial account and Custodian. Law was also updated in 2024.

What Type of Notarization Fits Your Lifestyle?

In-Person Traditional Mobile Notarizations for your Estate Documents are executed using traditional pen and paper in a "wet" signing session at your office, client home, client office or other convenient location.  You or your client keep the signed and notarized documents from the session. This is the traditional mobile notary method of executing your estate documents including your last will and testament. 

Remote Online Notarization(RON) of Estate Documents are executed online using online audio/visual communication technology according to Arizona law.  RON execution of a Last Will and Testament requires that the document be held in a custodial account by a qualified custodian. Our fee-free qualified custodians can manage all evidential documentation related to the electronic notarization of your Last Will and Testament required by Arizona lawin our EverSecure™ Digital Vault. Or, we can transfer the entire package to a qualified custodian of your choice. Or, you can close out your account according to AZ law.   

There are Arizona laws, statutes and rules for the evidential documentation which must be included in the custodial account, as well as laying out the duties and functions of the qualified custodian. Please discuss this with your legal advisor if you need clarification of the law.

Our services are available to Estate Planning Attorneys, Financial Planners, Wealth Managers, and Individuals who require help in executing the documents that make up a complete or partial estate plan according to the most current state statutes and rules. We can provide a fee-free qualified custodian to manage your EverSecure™ Digital Vault for electronic wills from any state that allows for this service (Except Florida where we can recomomend a qualified custodian for you).

All estate document executions when combined with the Secured Signing remote online platform include a Deep Fake Analysis on the Audio/Video feed to ensure that the signer is not an AI avatar committing a fradulent transaction.

EXECUTING YOUR ELECTRONIC LAST WILL AND TESTAMENT

Arizona Electronic Last Will and Testament Signing Ceremonies are allowed to be performed with Remote Online Notarization (RON). All electronically executed wills and codicils are delivered ready to be placed directly into our EverSecure™ Digital Vault (annual charge applies) upon completion of the signing ceremony.  Use AZ Roving Notary Custodial Services, Transfer the Account to the qualified custodian and account of your choice, or Close the Account). AZ House Bill 2197:14-2518,14-2519,14-2520. 

Effective Immediately: For documentary evidence for your electronically executed RON Last Will and Testament (or Codicil), you will need to purchase our Evidential Documentation Package and determine your Qualified Custodian and  Custodial Account.  The Evidential Documentation can only be produced at the time of the document fulfillment. Here is what is included in the evidential documentation:

  • Agreements between Qualified Custodian and Testator
  • Notarized oaths for 2 independent witnesses
  • Audio/Video recording of session to be stored in Custodial Account
  • Certified Transcript of Audio/Visual Recording (AI produced)
  • Image of video screen showing contemporaneous participatoin of all signers.
  • Image of Screen Showing Testator at time of signing the will.
  • Identity Proofing documentation on all participants
  • Deep Fake Analysis results on all participants
  • Detailed Audit Trail from Signing Ceremony
  • Chain of Custody for Probate or Contesting
  • Instructions regarding the Qualified Custodian and Custodial Account
  • Contact Information for All Participants

The EverSecure™Digital Vault we use for the custodial account is the same one that many police departments, the FBI and homeland security use for digital evidential storage.  The platform uses encryption, hashes, blockchain and other methods to secure the files as well as a Chain of Custody for the entire file. AZ Roving Notary has set up a succession plan for the custodial account in case of death, close of business or bankruptcy.

EXECUTE YOUR ELECTRONIC WILL

Signature Format Disclaimer for Last Will and Testaments Executed online:

Signatures will be provided in a digital format created with a typed font, mouse or digital pen and protected by PKI technology.  Each of the digital signatures can include the date and time that the signer has signed the document - so that it coordinates with the audio/visual recording and meets the specification of evidential documentation required under the some state laws.  Although we recommend signing with your mouse (or finger/digital pen), please check with your legal advisor to determine what is required for your digital signature in your state.

Qualified Custodian and Custodial Account Disclaimer for RON:

AZ Roving Notary can provide you with Qualified Custodian and our EverSecure™ Digital Vault. Or, we can transfer the account to the qualified custodian and account of your choice. The custodial account will reside in our EverSecure™ Digital Vault for an annual fee of $180 per year for a minimum of 5 years beginning on day 31 post signing. 

You have the choice to:

  • Use the Qualfied Custodian w/Custodial Account provided by AZ Roving Notary
  • Use your own Qualified Custodian w/Custodial Account 
  • Close the account. Receive a Certified Paper Copy of your Last Will and Testament with all accompanying documental evidence.

ONLINE EXECUTION: DOCUMENT SUBMISSION PROCESS

To give you the best experience and ensure a smooth, on-time signing, we need your documents and signer details in advance. This allows us to complete the technical checks, set up the signing platform, and address any issues before your appointment.

When to Send Your Final Documents

Standard Sessions – Please send your final document(s) at least two (2) U.S. business days before your scheduled signing.

  • Upload your documents by Secure Link or Email? Your choice.
  • Signings The Day After Weekends or Federal Holidays – Please send your final document(s) no later than 12:00 PM Arizona time on the previous business day.
  • Why this matters: Early submission ensures we have time to verify your documents meet state law and technical requirements, avoiding last-minute rescheduling or delays. 

Information We Need With Your Documents

When you send your final document(s), please also include the following for all principal signers, witnesses, credible witnesses, and observers:

  • Email address
  • Phone number
  • Address
  • Type of ID (U.S. Passport, U.S. Driver’s License, or U.S. State-Issued ID Card) for each signer. Do not send us any images of the ID.
  • Why this matters: We use this information to set up secure access, verify identity, and comply with Arizona RON/iPEN legal requirements.

Document Formatting Requirements

Please complete all fillable fields before submission, except:

  • Signatures
  • Initials
  • Witness information
  • Dates as of the Day of Signing
  • If you are submitting more than one document, each document should be sent as its own PDF file.

Note: If we need to separate one combined PDF into multiple files, a $25.00 fee per document will apply.

Why this matters: Correct formatting helps prevent technical errors during signing and ensures the session stays within the scheduled time.
