By making payment on your invoice, you acknowledge that you have read, understood, and accepted all terms and conditions of this transaction (terms and conditions may be found on this website, the quote and the invoice. All invoice terms and conditions are the ones that are considered in effect along with the addtional terms and conditions found on this website.

Contracting Party

• You are contracting with PowerVision360 Productions, LLC d/b/a AZ Roving Notary for this transaction.
• Your payment includes our payment to the assigned notary for:               State-regulated notarial act fees
   State-regulated mileage fees, where applicable

Scope of Responsibility

• AZ Roving Notary, its owners, and its contracted notaries are responsible only for the proper notarization of your documents.

• We are not responsible for:
  The contents of your documents
  Whether your documents are accepted by the receiving party

Legal Advice Disclaimer

• Our employees, contractors, and notaries are not attorneys.
• Under Arizona law, they cannot provide legal advice or make changes to your documents.
• Any questions about your documents must be directed to your legal advisor or document originator.

Qualified Custodian Disclaimer

• Arizona statutes require a licensed and bonded fiduciary to serve as a Qualified Custodian if a fee is charged for this service.
• A fee-free Qualified Custodian is not required to be a licensed fiduciary.
• All AZ Roving Notary only contracts Qualified Custodians who are fee-free and therefore not licensed fiduciaries.
• The annual $180.00 per account that you pay is for the storage in our EverSecure™ Digital Evidence Vault.
• Transactional charges (transfer account, close account, prepare for probate) are agency fees and not Qualified Custodian fees.  The Qualifed Custodian directs the Agency.

Payment Policy – RON & iPEN Transactions

To reserve your signing session and ensure we have all resources in place (including notaries, witnesses, and technical setup), pre-payment is required. Please review the following guidelines to avoid rush charges or scheduling delays.

Quotes

• Price quotes are provided via email and remain valid for 10 business days from the date of the email.
• If a quote expires, a new quote must be issued before payment can be made.

Pre-Payment Deadlines

• Payment must be received at least two (2) U.S. business days prior to your session.
• If your payment date falls on the day after a weekend or federal holiday, it must be submitted no later than 12:00 PM Arizona time on the preceding business day.

How to Pay

• You will receive an electronic invoice by email with a secure payment button. Payments can be made via credit card at no additional charge.

Rush Charges

• Same-day Remote Online Notarization (RON) requires a 50% rush fee.

• Same-day service is subject to:

• No sessions will be scheduled with less than 4 hours notice.

Business Hours & Premium Hours

• Regular business hours: Monday–Friday, 8:30 AM – 5:00 PM Arizona time, excluding weekends and federal holidays.

• Premium hours: Any session start time outside regular hours is subject to an additional fee of $50–$100.

6. Document Uploads After Payment

• Once payment is received, if you haven't already, you may upload the final version of your document(s).

• Any revisions after final submission will require a pre-paid document update charge.

7. Final Payment Terms: 

All payments are final. Please see our Refund Policy for details.

NOTE:  If the option for contracting a Qualified Custodian/Custodial account from AZ Roving Notary is chosen, you must pay the annual renewal fee ontime.  Payment is upon receipt of invoice.  If we don't receive payment by the date of renewal, you will receive a registered letter to the address of record in the account stating that your account will be terminated in 30 days.  If you choose not to renew - you will receive by registered letter to the addess of record your certified paper Last Will and Testament (or Codicil). AZ Roving Notary will hold the documentary evidence until payment in full for amount due on the account.  Payment accumulates on a monthly basis for the documentary evidence at the rate of $18.00 per month. If your document goes to probate before the amount due is paid - we will provide the court with the necessary documentary evidence for the current rate of delivery of the document as well as the past due amount.

Reschedule Policy

We understand that schedules can change. We aim to be as flexible as possible while ensuring fairness and efficiency in rescheduling appointments. Please review the following guidelines.

1. General Rescheduling

• Sessions may be rescheduled at any time, including during the session itself, based on notary availability.

• Rescheduling Fee: $35.00 per participant.

2. Document Updates After Rescheduling

• If your session is rescheduled, your documents may require updates (e.g., date/time changes, re-preparation for the signing platform).

3. No-Fee Rescheduling Exceptions

No reschedule or document update fees will apply if the session fails due to:

• Failure of the notary’s computer

• Failure of the notary’s internet connection

• Failure of the RON platform

4. Reschedule Fees for Participant-Related Issues

A reschedule fee plus any applicable document update charges will apply if the session fails due to:

• Failure of any participant’s computer, internet, or technical requirements

• Failure of any participant’s Knowledge-Based Authentication (KBA) Quiz after 2 attempts

• Failure of any participant’s Credential Analysis or Facial Recognition

• Failure of any participant's Deep Fake Analysis.

• Failure to appear in the session within 10 minutes of the scheduled start time

• Why this matters: These issues prevent the session from being completed and require additional time and setup to reschedule.

5. Notarial Certificate Errors

• If the notary makes an error on the notarial certificate (provided by you or prepared by us at your request), we will reschedule at no charge to correct the error.

• If the error is caused by the signer (e.g., requesting an acknowledgment when a jurat was required), it will be considered a new transaction, requiring:

  • A new invoice

  • A new session (fee determined by circumstances)

6. Reschedule Time Limits

• You must reschedule within 30 days of receiving a notification to reschedule.

• If you do not reschedule within 30 days:

Refund & Cancellation Policy

We strive to provide fair and transparent refund and cancellation terms while ensuring the integrity of our scheduling and compliance processes.

Refund Processing

• Refunds are typically processed within 1–10 days, depending on the original payment method.

• In certain cases, refunds may need to be issued via check or paid by Zelle rather than the original payment method.

Our Right to Cancel

Non-Refundable Situations

Refunds will not be issued for the following:

• Refusal of a receiving agency to accept a valid RON-notarized document

• Failure to check email for platform invitations (including spam, junk or promotions folders)

• Payment made without scheduling your session within 30 days of payment is considered an abandoned job and there will be no refund. However 50% of the payment may be applied to another job if used within the same year.

• Canceling without rescheduling within 30 days of payment is considered abandoned and no refund is offered.

Cancellations by Client

• All cancellations are subject to a refund of 0–100% of the total invoice amount, based on the work already performed and expenses incurred.

Communication Tips to Avoid Refund Issues

• Verify with your receiving agency that a RON-notarized document will be accepted before booking.

Liability Policy – RON & iPEN Transactions

AZ Roving Notary is committed to providing accurate, legal, and secure notarial services. Please review the following terms regarding our liability and the client’s responsibilities.

Validity of Remote Online Notarization (RON)

• Remote Online Notarizations performed by a properly commissioned notary are valid in all 50 U.S. states, U.S. territories, and Washington, D.C., under reciprocal recognition laws.

• It is the client’s responsibility to confirm with the final document recipient that they will accept a RON-notarized document.

• AZ Roving Notary, its contracted notaries, and platform providers are not liable if a lawfully completed RON is later rejected by the recipient.

Accuracy of Client-Provided Documents

• AZ Roving Notary and its contracted notaries are not responsible for errors in documents provided by the client.

• Errors found after the signing is finalized will require a new invoice for the full amount.

• Errors found during the signing will require:

  • A reschedule fee

  • Any additional charges to complete the signing with updated documents

• Errors found before the signing but after it is scheduled may result in a 0–100% change-out fee plus a reschedule fee, depending on costs incurred.

Role of Independently Contracted Notaries

• AZ Roving Notary operates as a signing agency and uses independently contracted notaries. All notaries are paid by the agency in accordance with their state laws regarding notary fees.

• Clients do not pay notary fees directly to the notary; all state-regulated fees are paid from your contracted transaction with the agency.

• We take no responsibility for work performed or errors committed by independent notaries, other than offering to repeat the transaction at no charge with a different notary.

• The maximum liability of AZ Roving Notary, its owners, members, managers, or contractors is limited to:

  • The amount of your transaction invoice

  • Any additional platform charges incurred for the session

4. Platform Licensing & Security

• AZ Roving Notary licenses its Remote Online Notary, In-Person Electronic Notary, and Custodial Account platforms from third-party providers. These third parties are reponsible for the privacy and security of their platforms.

• AZ Roving Notary provides a no-fee Qualified Custodian for Electronic wills per state statue and therefore our Qualified Custodians do not hold a fiduciary license or carry a fiduciary bond.

• If a security breach occurs, AZ Roving Notary will notify you and relay the remedy offered by the third party.

• Why this matters: We partner only with vetted, compliant technology providers, but responsibility for platform-level breaches lies with them.

Dispute Policy

Liability Limitations

Resolution of Notarization Issues

• In the event of a notarization error caused by the notary, AZ Roving Notary will either:

  • Repeat the session at no charge, or

  • Refund the full invoice amount

• We are not liable for claims made against the notarized documents themselves.

Delays & Penalties

• AZ Roving Notary, its owners, and contracted notaries are not responsible for any penalties, damages, or losses caused by lateness, rescheduling, or delivery delays.

• The client is fully responsible for notifying the recipient of any delays and assumes all liability for consequences.

Dispute Process

• Any dispute regarding a notarization must be submitted in writing to the AZ Roving Notary contact person via the provided email address.

• If the notary is found to have improperly notarized a document, AZ Roving Notary will provide a new signing session at no charge, using:

  • The same notary and platform, or

  • A different notary and platform, at the client’s choice

All disputes will resolved with Maricopa County, Arizona being the venue and will follow Arizona law. Mediation is the preferred method of resolving disputes. PowerVision360 Productions, LLC d/b/a accepts no liability except for the full amount paid on the invoice(s) by the client.
